User Agreement
1. General Provisions
1.1. This User Agreement (hereinafter — the “Agreement”) governs the terms of use of the Zama platform (hereinafter — the “Platform”).
1.2. By
using the Platform, any person (client, professional, salon, other
user) confirms that they:
• have read the terms of the
Agreement;
• understand the nature of the Platform and the
limitations of liability;
• accept the terms of the Agreement
in full.
1.3. If the user does not agree with the terms of the Agreement, they must discontinue use of the Platform.
2. Status of the Zama Platform
2.1. Zama is solely a technological platform (software and technical service) for interaction between users, professionals, and salons.
2.2. The
Platform:
• does not provide beauty services;
• is not
an employer of professionals / salons;
• is not a party to any
contract (transaction) between a client and a professional / salon;
•
does not guarantee the quality, safety, legality, timeliness, or
results of services;
• is not a guarantor of the performance
of obligations between users.
2.3. All relationships related to the provision of services arise directly between the client and the professional / salon.
3. Status of Professionals and Salons. No Verification
3.1. Professionals and salons are independent and autonomous participants of the Platform.
3.2. The
Platform does not perform verification of professionals / salons,
including but not limited to:
• identity checks;
•
qualification checks;
• verification of licenses,
certificates, diplomas, or permits;
• verification of the
accuracy of information provided in profiles.
3.3. Any information posted by a professional / salon (contacts, social media, messengers, service descriptions, qualifications, experience, etc.) is provided independently and is not verified by the Platform.
3.4. The
Platform is not a guarantor of:
• the good faith of the
service provider;
• the competence of the service provider;
•
the legality of the service provider’s activities;
• the
compliance of the service provider with client expectations.
4. Use of the Platform and Functionality
4.1. The
Platform provides technical tools, including:
• registration
and profile management;
• searching for service providers;
•
booking services;
• messaging (chat);
• managing
bookings (within available functionality);
• reviews, ratings,
and rankings;
• other functions available in the interface.
4.2. The Platform may at any time modify, restrict, supplement, or remove any functionality without prior notice and without compensation to users, unless otherwise required by applicable law.
5. Automated Systems and AI (Artificial Intelligence)
5.1. Right of
the Platform to Use AI and Automation
The Platform may use
automated technologies, including artificial intelligence (AI)
systems, algorithms, and other software tools to ensure the operation
of the service.
5.2. Scope of
AI / Automation Usage
Automated systems and AI may be used,
including but not limited to:
• interactions with users in
chats;
• request processing;
• service bookings;
•
rescheduling and cancellation of bookings;
• processing of
messages and communications;
• analysis of user data and
behavior;
• service personalization;
• generation of
recommendations and offers.
5.3. Variable
Nature of Interaction (Human / AI)
The user understands and
agrees that interactions on the Platform (including chats) may occur
via:
• automated systems (including AI),
• humans
(including representatives of professionals / salons),
• a
combination of both.
5.4. No
Obligation to Disclose Specific Mode
The Platform is not
required to notify users whether a particular interaction is
performed by a human, an AI system, or a mixed mode.
5.5.
Limitations and No Guarantees Regarding AI
The user
acknowledges that:
• AI and automated systems may contain
errors, inaccuracies, delays, or incorrect interpretations;
•
AI outputs are informational / service-based in nature;
•
AI-generated messages do not create legal obligations of the
Platform;
• the Platform does not guarantee absolute accuracy
or error-free operation of AI.
5.6. AI as a
Service Feature
The use of AI may depend on system
configuration, settings, available functionality, and enabled
features of professionals / salons. The Platform does not guarantee
that AI is used in all chats or scenarios.
6. Communications and Chats
6.1. The Platform provides the technical ability for users to exchange messages.
6.2. The
Platform:
• is not a party to communications;
• does
not guarantee delivery, reading, or timely processing of messages;
•
is not obligated to participate in dispute resolution;
• is
not obligated to treat communications as formal claims against the
Platform.
6.3. Messages and correspondence may be stored and retained in accordance with the Privacy Policy.
7. Financial Terms, Prepayments, and Payment Functions
7.1.
Prepayments and Conditions of Professionals / Salons
Professionals
/ salons may independently establish the terms of service provision,
including:
• prepayment requirements;
• cancellation
policies;
• other financial terms of interaction with clients.
7.2. Role of
the Platform in Payments (at the Current Stage)
Unless
explicitly stated otherwise within the Platform’s functionality,
settlements between the client and the professional / salon are
conducted directly between them.
The Platform:
•
does not participate in settlements;
• is not a payment
agent;
• is not a holder or custodian of funds;
• does
not control refunds or financial settlements between parties;
•
bears no responsibility for payments, transfers, prepayments, or
other financial transactions between users.
7.3. Future
Payment Mechanisms
The Platform may introduce payment tools
and/or engage third-party payment providers in the future. In such
cases, additional terms may apply and will be published separately by
the Platform.
8. Financial Disputes and Refunds
8.1. The Platform fully distances itself from financial disputes between clients and professionals / salons.
8.2. The
Platform does not review or resolve disputes, including but not
limited to:
• prepayment refunds;
• retention of
prepayments;
• compensations;
• disputes regarding
service prices;
• disputes regarding services not provided or
partially provided;
• other mutual financial claims between
parties.
8.3. All such disputes are resolved directly between the client and the professional / salon.
9. No Warranties and “As Is” Service Provision
9.1. The Platform is provided on an “as is” and “as available” basis.
9.2. The
Platform does not guarantee:
• uninterrupted and error-free
operation;
• absence of errors, failures, or loss of access;
•
compliance with user expectations;
• absence of technical
limitations;
• accuracy of any automated features, algorithms,
ratings, analytics, or AI.
👤 Section for Clients (Service Users)
10. Role of the Client
10.1. The client uses the Platform to search for professionals / salons, book services, and interact with them.
10.2. The
Platform bears no responsibility for:
• the actual provision
or non-provision of services;
• the quality of services;
•
rescheduling / cancellation by professionals / salons;
• the
behavior of professionals / salons;
• consequences of
interactions between the client and the service provider.
11. Service Bookings, Changes, Cancellations, No-Show
11.1. The Platform provides the technical ability to create bookings.
11.2. The Platform does not guarantee the actual provision of services after booking.
11.3. Terms of service provision, cancellation, rescheduling, prepayments, and other conditions may be determined by the professional / salon.
11.4. In
cases of repeated cancellations, no-shows, abuse of booking
functions, or other bad-faith behavior, the Platform may apply
restrictions to the client, including:
• requiring prepayments
for future bookings;
• restricting access to booking
features;
• other measures at the Platform’s discretion.
11.5. The Platform is not obligated to disclose evaluation criteria, detection algorithms, or evidence supporting applied restrictions.
12. Transfer of Data to Service Providers
12.1. By creating a booking, the client agrees that their data necessary for booking fulfillment and communication (including phone number, name, booking details, date, time, service, and other provided information) may be shared with the selected professional / salon.
12.2. Such transfer is an integral part of the Platform’s functionality.
12.3. The Platform does not control further use of data by professionals / salons outside the Zama technical infrastructure and bears no responsibility for such actions.
13. Reviews, Ratings, and Rankings (for Clients)
13.1. The Platform may provide clients with the ability to leave reviews and ratings regarding professionals / salons.
13.2. The
ability to leave a review may be restricted and may be available only
to users who:
• completed a booking through the Platform;
and
• had an actual interaction (service visit) with the
professional / salon.
13.3.
Reviews and ratings:
• represent the subjective opinion of the
user;
• do not reflect the position of the Platform;
•
are not verified by the Platform for accuracy, completeness, or
objectivity.
13.4. The Platform bears no responsibility for the content of reviews, comments, ratings, or other user-generated content.
13.5. The
Platform may, at its sole discretion:
• publish, hide, delete,
or refuse to publish reviews;
• modify the display order of
reviews and ratings;
• perform moderation without providing
explanations.
13.6. The Platform is not obligated to act as an arbiter in disputes regarding the validity, correctness, or fairness of reviews.
💼 Section for Professionals / Salons
14. Role of Professionals and Salons
14.1. Professionals / salons use the Platform as a technological tool for organizing their activities, interacting with clients, and managing bookings.
14.2. The
Platform:
• does not guarantee client flow;
• does not
guarantee booking volume;
• bears no responsibility for
commercial results, revenue, workload, profit, or losses of
professionals / salons.
15. Responsibility of Professionals / Salons for Data and Content
15.1. The
professional / salon is solely responsible for:
• the accuracy
of posted information;
• correctness of service
descriptions;
• schedule relevance;
• validity of
contact details;
• fulfillment of obligations toward clients.
15.2. The professional / salon bears full responsibility for the use of client data and must comply with applicable laws when processing such data.
15.3. The Platform bears no responsibility for violations of law, client rights, or third-party rights committed by professionals / salons.
16. Accounting, Inventory, Analytics, and Statistics Tools
16.1. The
Platform may provide professionals / salons with accounting tools,
including (where functionality exists):
• inventory
management;
• analytics;
• statistics;
• other
operational tools.
16.2. Such tools are auxiliary in nature and do not constitute a financial, tax, accounting, or management accounting system unless explicitly stated otherwise by the Platform.
16.3. The Platform does not guarantee absolute accuracy of calculations, analytics, or statistics.
16.4. The professional / salon acknowledges that data accuracy depends on user-entered information and user actions (including human factors).
16.5.
Responsibility for:
• correctness of data input;
•
completeness of data;
• consequences of errors, inaccuracies,
or omissions
rests entirely with the professional / salon.
16.6. The Platform bears no responsibility for losses, accounting errors, inventory discrepancies, statistical deviations, or management decisions based on Platform data.
17. Reviews, Rankings, and Algorithms (for Professionals / Salons)
17.1. The Platform may generate rankings, search results, and profile displays of professionals / salons using automated algorithms.
17.2. Rankings, ratings, and search results may consider various factors determined by the Platform and may be modified without prior notice.
17.3. The
Platform does not guarantee:
• objectivity of algorithms;
•
stability of positions in search results;
• preservation of
rankings;
• compliance of rankings with expectations of
professionals / salons.
17.4. The Platform bears no responsibility for commercial consequences related to rankings, reviews, search positions, or algorithmic ordering.
⚖️ Final Provisions (Applicable to All Users)
18. Moderation, Restrictions, and Account Blocking
18.1. The
Platform may, at its sole discretion, at any time, with or without
notice:
• restrict access to the Platform;
• restrict
specific functions;
• suspend account access;
• block
users;
• delete accounts.
18.2.
Grounds for such actions may include, but are not limited to:
•
violation of the Agreement;
• abuse of Platform
functionality;
• bad-faith behavior;
• complaints from
other users;
• actions creating risks for the Platform or
users;
• rude, abusive, or aggressive behavior;
• other
circumstances at the Platform’s discretion.
18.3. The
Platform:
• is not obligated to provide prior notice;
•
is not obligated to explain reasons;
• is not obligated to
provide evidence;
• is not obligated to restore access.
18.4. Restriction or termination of access does not create obligations for compensation, damages, or reimbursement by the Platform.
19. Data Retention in Cases of Restrictions / Blocking
19.1. In
cases of account suspension, restriction, or blocking, the Platform
may retain data associated with the account, including:
•
profile information;
• activity history;
•
correspondence;
• other service-related data.
19.2. Data
may be retained for a reasonable period for purposes including:
•
investigation of potential violations;
• ensuring Platform
security;
• dispute resolution;
• compliance with
applicable laws.
19.3. The Platform may conduct internal investigations at its discretion. The timing and procedures of such investigations are not guaranteed.
19.4. The Platform may restore access where no violations are confirmed but is not obligated to do so and is not required to disclose investigation details.
20. Account and Data Deletion
20.1. In the event of permanent account deletion, the Platform shall take reasonable measures to remove user data from active Platform systems within a reasonable timeframe, taking into account technical characteristics of the infrastructure.
20.2. The
Platform may retain certain data where necessary for:
•
compliance with legal obligations;
• dispute resolution;
•
ensuring security;
• prevention of abuse;
• fulfillment
of statutory requirements.
21. Limitation of Platform Liability (Maximum Extent Permitted)
21.1. To the maximum extent permitted by applicable law, the Zama Platform shall not be liable for any losses, damages, or harm arising from the use of or inability to use the Platform.
21.2. In
particular, the Platform shall not be liable for:
• direct,
indirect, incidental, special, punitive, or consequential damages;
•
loss of profits;
• loss of revenue, clients, or business
reputation;
• loss or distortion of data;
• actions or
omissions of clients, professionals, salons, or other users;
•
quality, legality, safety, or results of services;
• service
interruptions, errors, or failures;
• operation of AI systems,
algorithms, analytics, rankings, or recommendations.
21.3. Even if the Platform has been advised of the possibility of damages, this shall not create additional liability.
21.4. Where liability is recognized by a competent authority or court, such liability shall be limited to the minimum extent permitted by law.
22. Amendments to the Agreement
22.1. The Platform may amend this Agreement at any time.
22.2. The current version shall be published within the Platform interface and/or by other means determined by the Platform.
22.3. Continued use of the Platform after amendments constitutes acceptance of the updated Agreement.
23. Governing Law and Disputes
23.1. Relationships arising from the use of the Platform shall be governed by the law determined by the Platform, taking into account the international nature of the service and applicable legal requirements.
23.2. Nothing in this Agreement limits rights that cannot be waived or restricted under mandatory provisions of applicable law.
24. Acceptance of Terms
24.1. Use of the Platform, account registration, booking creation, chat usage, review functions, AI features, or other Platform capabilities constitutes full and unconditional acceptance of this Agreement.
