Status of\nthe Zama Platform\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>2.1.\u003C/b> Zama\nis solely a technological platform (software and technical service)\nfor interaction between users, professionals, and salons.\u003C/p>\n\u003Cp>\u003Cb>2.2.\u003C/b> The\nPlatform:\u003Cbr/>\n• does not provide beauty services;\u003Cbr/>\n• is not\nan employer of professionals / salons;\u003Cbr/>\n• is not a party to any\ncontract (transaction) between a client and a professional / salon;\u003Cbr/>\n•\ndoes not guarantee the quality, safety, legality, timeliness, or\nresults of services;\u003Cbr/>\n• is not a guarantor of the performance\nof obligations between users.\u003C/p>\n\u003Cp>\u003Cb>2.3.\u003C/b> All\nrelationships related to the provision of services arise directly\nbetween the client and the professional / salon.\u003C/p>\n\u003Cp>\u003Cb>3. Status of\nProfessionals and Salons. No Verification\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>3.1.\u003C/b>\nProfessionals and salons are independent and autonomous participants\nof the Platform.\u003C/p>\n\u003Cp>\u003Cb>3.2.\u003C/b> The\nPlatform does not perform verification of professionals / salons,\nincluding but not limited to:\u003Cbr/>\n• identity checks;\u003Cbr/>\n•\nqualification checks;\u003Cbr/>\n• verification of licenses,\ncertificates, diplomas, or permits;\u003Cbr/>\n• verification of the\naccuracy of information provided in profiles.\u003C/p>\n\u003Cp>\u003Cb>3.3.\u003C/b> Any\ninformation posted by a professional / salon (contacts, social media,\nmessengers, service descriptions, qualifications, experience, etc.)\nis provided independently and is not verified by the Platform.\u003C/p>\n\u003Cp>\u003Cb>3.4.\u003C/b> The\nPlatform is not a guarantor of:\u003Cbr/>\n• the good faith of the\nservice provider;\u003Cbr/>\n• the competence of the service provider;\u003Cbr/>\n•\nthe legality of the service provider’s activities;\u003Cbr/>\n• the\ncompliance of the service provider with client expectations.\u003C/p>\n\u003Cp>\u003Cb>4. Use of the\nPlatform and Functionality\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>4.1.\u003C/b> The\nPlatform provides technical tools, including:\u003Cbr/>\n• registration\nand profile management;\u003Cbr/>\n• searching for service providers;\u003Cbr/>\n•\nbooking services;\u003Cbr/>\n• messaging (chat);\u003Cbr/>\n• managing\nbookings (within available functionality);\u003Cbr/>\n• reviews, ratings,\nand rankings;\u003Cbr/>\n• other functions available in the interface.\u003C/p>\n\u003Cp>\u003Cb>4.2.\u003C/b> The\nPlatform may at any time modify, restrict, supplement, or remove any\nfunctionality without prior notice and without compensation to users,\nunless otherwise required by applicable law.\u003C/p>\n\u003Cp>\u003Cb>5. Automated\nSystems and AI (Artificial Intelligence)\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>5.1. Right of\nthe Platform to Use AI and Automation\u003C/b>\u003Cbr/>\nThe Platform may use\nautomated technologies, including artificial intelligence (AI)\nsystems, algorithms, and other software tools to ensure the operation\nof the service.\u003C/p>\n\u003Cp>\u003Cb>5.2. Scope of\nAI / Automation Usage\u003C/b>\u003Cbr/>\nAutomated systems and AI may be used,\nincluding but not limited to:\u003Cbr/>\n• interactions with users in\nchats;\u003Cbr/>\n• request processing;\u003Cbr/>\n• service bookings;\u003Cbr/>\n•\nrescheduling and cancellation of bookings;\u003Cbr/>\n• processing of\nmessages and communications;\u003Cbr/>\n• analysis of user data and\nbehavior;\u003Cbr/>\n• service personalization;\u003Cbr/>\n• generation of\nrecommendations and offers.\u003C/p>\n\u003Cp>\u003Cb>5.3. Variable\nNature of Interaction (Human / AI)\u003C/b>\u003Cbr/>\nThe user understands and\nagrees that interactions on the Platform (including chats) may occur\nvia:\u003Cbr/>\n• automated systems (including AI),\u003Cbr/>\n• humans\n(including representatives of professionals / salons),\u003Cbr/>\n• a\ncombination of both.\u003C/p>\n\u003Cp>\u003Cb>5.4. No\nObligation to Disclose Specific Mode\u003C/b>\u003Cbr/>\nThe Platform is not\nrequired to notify users whether a particular interaction is\nperformed by a human, an AI system, or a mixed mode.\u003C/p>\n\u003Cp>\u003Cb>5.5.\nLimitations and No Guarantees Regarding AI\u003C/b>\u003Cbr/>\nThe user\nacknowledges that:\u003Cbr/>\n• AI and automated systems may contain\nerrors, inaccuracies, delays, or incorrect interpretations;\u003Cbr/>\n•\nAI outputs are informational / service-based in nature;\u003Cbr/>\n•\nAI-generated messages do not create legal obligations of the\nPlatform;\u003Cbr/>\n• the Platform does not guarantee absolute accuracy\nor error-free operation of AI.\u003C/p>\n\u003Cp>\u003Cb>5.6. AI as a\nService Feature\u003C/b>\u003Cbr/>\nThe use of AI may depend on system\nconfiguration, settings, available functionality, and enabled\nfeatures of professionals / salons. The Platform does not guarantee\nthat AI is used in all chats or scenarios.\u003C/p>\n\u003Cp>\u003Cb>6.\nCommunications and Chats\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>6.1.\u003C/b> The\nPlatform provides the technical ability for users to exchange\nmessages.\u003C/p>\n\u003Cp>\u003Cb>6.2.\u003C/b> The\nPlatform:\u003Cbr/>\n• is not a party to communications;\u003Cbr/>\n• does\nnot guarantee delivery, reading, or timely processing of messages;\u003Cbr/>\n•\nis not obligated to participate in dispute resolution;\u003Cbr/>\n• is\nnot obligated to treat communications as formal claims against the\nPlatform.\u003C/p>\n\u003Cp>\u003Cb>6.3.\u003C/b>\nMessages and correspondence may be stored and retained in accordance\nwith the Privacy Policy.\u003C/p>\n\u003Cp>\u003Cb>7. Financial\nTerms, Prepayments, and Payment Functions\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>7.1.\nPrepayments and Conditions of Professionals / Salons\u003C/b>\u003Cbr/>\nProfessionals\n/ salons may independently establish the terms of service provision,\nincluding:\u003Cbr/>\n• prepayment requirements;\u003Cbr/>\n• cancellation\npolicies;\u003Cbr/>\n• other financial terms of interaction with clients.\u003C/p>\n\u003Cp>\u003Cb>7.2. Role of\nthe Platform in Payments (at the Current Stage)\u003C/b>\u003Cbr/>\nUnless\nexplicitly stated otherwise within the Platform’s functionality,\nsettlements between the client and the professional / salon are\nconducted directly between them.\u003C/p>\n\u003Cp>The Platform:\u003Cbr/>\n•\ndoes not participate in settlements;\u003Cbr/>\n• is not a payment\nagent;\u003Cbr/>\n• is not a holder or custodian of funds;\u003Cbr/>\n• does\nnot control refunds or financial settlements between parties;\u003Cbr/>\n•\nbears no responsibility for payments, transfers, prepayments, or\nother financial transactions between users.\u003C/p>\n\u003Cp>\u003Cb>7.3. Future\nPayment Mechanisms\u003C/b>\u003Cbr/>\nThe Platform may introduce payment tools\nand/or engage third-party payment providers in the future. In such\ncases, additional terms may apply and will be published separately by\nthe Platform.\u003C/p>\n\u003Cp>\u003Cb>8. Financial\nDisputes and Refunds\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>8.1.\u003C/b> The\nPlatform fully distances itself from financial disputes between\nclients and professionals / salons.\u003C/p>\n\u003Cp>\u003Cb>8.2.\u003C/b> The\nPlatform does not review or resolve disputes, including but not\nlimited to:\u003Cbr/>\n• prepayment refunds;\u003Cbr/>\n• retention of\nprepayments;\u003Cbr/>\n• compensations;\u003Cbr/>\n• disputes regarding\nservice prices;\u003Cbr/>\n• disputes regarding services not provided or\npartially provided;\u003Cbr/>\n• other mutual financial claims between\nparties.\u003C/p>\n\u003Cp>\u003Cb>8.3.\u003C/b> All\nsuch disputes are resolved directly between the client and the\nprofessional / salon.\u003C/p>\n\u003Cp>\u003Cb>9. No\nWarranties and “As Is” Service Provision\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>9.1.\u003C/b> The\nPlatform is provided on an “as is” and “as available” basis.\u003C/p>\n\u003Cp>\u003Cb>9.2.\u003C/b> The\nPlatform does not guarantee:\u003Cbr/>\n• uninterrupted and error-free\noperation;\u003Cbr/>\n• absence of errors, failures, or loss of access;\u003Cbr/>\n•\ncompliance with user expectations;\u003Cbr/>\n• absence of technical\nlimitations;\u003Cbr/>\n• accuracy of any automated features, algorithms,\nratings, analytics, or AI.\u003C/p>\n\u003Cp>👤 \u003Cb>Section\nfor Clients (Service Users)\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>10. Role of\nthe Client\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>10.1.\u003C/b> The\nclient uses the Platform to search for professionals / salons, book\nservices, and interact with them.\u003C/p>\n\u003Cp>\u003Cb>10.2.\u003C/b> The\nPlatform bears no responsibility for:\u003Cbr/>\n• the actual provision\nor non-provision of services;\u003Cbr/>\n• the quality of services;\u003Cbr/>\n•\nrescheduling / cancellation by professionals / salons;\u003Cbr/>\n• the\nbehavior of professionals / salons;\u003Cbr/>\n• consequences of\ninteractions between the client and the service provider.\u003C/p>\n\u003Cp>\u003Cb>11. Service\nBookings, Changes, Cancellations, No-Show\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>11.1.\u003C/b> The\nPlatform provides the technical ability to create bookings.\u003C/p>\n\u003Cp>\u003Cb>11.2.\u003C/b> The\nPlatform does not guarantee the actual provision of services after\nbooking.\u003C/p>\n\u003Cp>\u003Cb>11.3.\u003C/b>\nTerms of service provision, cancellation, rescheduling, prepayments,\nand other conditions may be determined by the professional / salon.\u003C/p>\n\u003Cp>\u003Cb>11.4.\u003C/b> In\ncases of repeated cancellations, no-shows, abuse of booking\nfunctions, or other bad-faith behavior, the Platform may apply\nrestrictions to the client, including:\u003Cbr/>\n• requiring prepayments\nfor future bookings;\u003Cbr/>\n• restricting access to booking\nfeatures;\u003Cbr/>\n• other measures at the Platform’s discretion.\u003C/p>\n\u003Cp>\u003Cb>11.5.\u003C/b> The\nPlatform is not obligated to disclose evaluation criteria, detection\nalgorithms, or evidence supporting applied restrictions.\u003C/p>\n\u003Cp>\u003Cb>12. Transfer\nof Data to Service Providers\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>12.1.\u003C/b> By\ncreating a booking, the client agrees that their data necessary for\nbooking fulfillment and communication (including phone number, name,\nbooking details, date, time, service, and other provided information)\nmay be shared with the selected professional / salon.\u003C/p>\n\u003Cp>\u003Cb>12.2.\u003C/b> Such\ntransfer is an integral part of the Platform’s functionality.\u003C/p>\n\u003Cp>\u003Cb>12.3.\u003C/b> The\nPlatform does not control further use of data by professionals /\nsalons outside the Zama technical infrastructure and bears no\nresponsibility for such actions.\u003C/p>\n\u003Cp>\u003Cb>13. Reviews,\nRatings, and Rankings (for Clients)\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>13.1.\u003C/b> The\nPlatform may provide clients with the ability to leave reviews and\nratings regarding professionals / salons.\u003C/p>\n\u003Cp>\u003Cb>13.2.\u003C/b> The\nability to leave a review may be restricted and may be available only\nto users who:\u003Cbr/>\n• completed a booking through the Platform;\nand\u003Cbr/>\n• had an actual interaction (service visit) with the\nprofessional / salon.\u003C/p>\n\u003Cp>\u003Cb>13.3.\u003C/b>\nReviews and ratings:\u003Cbr/>\n• represent the subjective opinion of the\nuser;\u003Cbr/>\n• do not reflect the position of the Platform;\u003Cbr/>\n•\nare not verified by the Platform for accuracy, completeness, or\nobjectivity.\u003C/p>\n\u003Cp>\u003Cb>13.4.\u003C/b> The\nPlatform bears no responsibility for the content of reviews,\ncomments, ratings, or other user-generated content.\u003C/p>\n\u003Cp>\u003Cb>13.5.\u003C/b> The\nPlatform may, at its sole discretion:\u003Cbr/>\n• publish, hide, delete,\nor refuse to publish reviews;\u003Cbr/>\n• modify the display order of\nreviews and ratings;\u003Cbr/>\n• perform moderation without providing\nexplanations.\u003C/p>\n\u003Cp>\u003Cb>13.6.\u003C/b> The\nPlatform is not obligated to act as an arbiter in disputes regarding\nthe validity, correctness, or fairness of reviews.\u003C/p>\n\u003Cp>💼 \u003Cb>Section\nfor Professionals / Salons\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>14. Role of\nProfessionals and Salons\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>14.1.\u003C/b>\nProfessionals / salons use the Platform as a technological tool for\norganizing their activities, interacting with clients, and managing\nbookings.\u003C/p>\n\u003Cp>\u003Cb>14.2.\u003C/b> The\nPlatform:\u003Cbr/>\n• does not guarantee client flow;\u003Cbr/>\n• does not\nguarantee booking volume;\u003Cbr/>\n• bears no responsibility for\ncommercial results, revenue, workload, profit, or losses of\nprofessionals / salons.\u003C/p>\n\u003Cp>\u003Cb>15.\nResponsibility of Professionals / Salons for Data and Content\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>15.1.\u003C/b> The\nprofessional / salon is solely responsible for:\u003Cbr/>\n• the accuracy\nof posted information;\u003Cbr/>\n• correctness of service\ndescriptions;\u003Cbr/>\n• schedule relevance;\u003Cbr/>\n• validity of\ncontact details;\u003Cbr/>\n• fulfillment of obligations toward clients.\u003C/p>\n\u003Cp>\u003Cb>15.2.\u003C/b> The\nprofessional / salon bears full responsibility for the use of client\ndata and must comply with applicable laws when processing such data.\u003C/p>\n\u003Cp>\u003Cb>15.3.\u003C/b> The\nPlatform bears no responsibility for violations of law, client\nrights, or third-party rights committed by professionals / salons.\u003C/p>\n\u003Cp>\u003Cb>16.\nAccounting, Inventory, Analytics, and Statistics Tools\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>16.1.\u003C/b> The\nPlatform may provide professionals / salons with accounting tools,\nincluding (where functionality exists):\u003Cbr/>\n• inventory\nmanagement;\u003Cbr/>\n• analytics;\u003Cbr/>\n• statistics;\u003Cbr/>\n• other\noperational tools.\u003C/p>\n\u003Cp>\u003Cb>16.2.\u003C/b> Such\ntools are auxiliary in nature and do not constitute a financial, tax,\naccounting, or management accounting system unless explicitly stated\notherwise by the Platform.\u003C/p>\n\u003Cp>\u003Cb>16.3.\u003C/b> The\nPlatform does not guarantee absolute accuracy of calculations,\nanalytics, or statistics.\u003C/p>\n\u003Cp>\u003Cb>16.4.\u003C/b> The\nprofessional / salon acknowledges that data accuracy depends on\nuser-entered information and user actions (including human factors).\u003C/p>\n\u003Cp>\u003Cb>16.5.\u003C/b>\nResponsibility for:\u003Cbr/>\n• correctness of data input;\u003Cbr/>\n•\ncompleteness of data;\u003Cbr/>\n• consequences of errors, inaccuracies,\nor omissions\u003Cbr/>\nrests entirely with the professional / salon.\u003C/p>\n\u003Cp>\u003Cb>16.6.\u003C/b> The\nPlatform bears no responsibility for losses, accounting errors,\ninventory discrepancies, statistical deviations, or management\ndecisions based on Platform data.\u003C/p>\n\u003Cp>\u003Cb>17. Reviews,\nRankings, and Algorithms (for Professionals / Salons)\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>17.1.\u003C/b> The\nPlatform may generate rankings, search results, and profile displays\nof professionals / salons using automated algorithms.\u003C/p>\n\u003Cp>\u003Cb>17.2.\u003C/b>\nRankings, ratings, and search results may consider various factors\ndetermined by the Platform and may be modified without prior notice.\u003C/p>\n\u003Cp>\u003Cb>17.3.\u003C/b> The\nPlatform does not guarantee:\u003Cbr/>\n• objectivity of algorithms;\u003Cbr/>\n•\nstability of positions in search results;\u003Cbr/>\n• preservation of\nrankings;\u003Cbr/>\n• compliance of rankings with expectations of\nprofessionals / salons.\u003C/p>\n\u003Cp>\u003Cb>17.4.\u003C/b> The\nPlatform bears no responsibility for commercial consequences related\nto rankings, reviews, search positions, or algorithmic ordering.\u003C/p>\n\u003Cp>⚖️ \u003Cb>Final\nProvisions (Applicable to All Users)\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>18.\nModeration, Restrictions, and Account Blocking\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>18.1.\u003C/b> The\nPlatform may, at its sole discretion, at any time, with or without\nnotice:\u003Cbr/>\n• restrict access to the Platform;\u003Cbr/>\n• restrict\nspecific functions;\u003Cbr/>\n• suspend account access;\u003Cbr/>\n• block\nusers;\u003Cbr/>\n• delete accounts.\u003C/p>\n\u003Cp>\u003Cb>18.2.\u003C/b>\nGrounds for such actions may include, but are not limited to:\u003Cbr/>\n•\nviolation of the Agreement;\u003Cbr/>\n• abuse of Platform\nfunctionality;\u003Cbr/>\n• bad-faith behavior;\u003Cbr/>\n• complaints from\nother users;\u003Cbr/>\n• actions creating risks for the Platform or\nusers;\u003Cbr/>\n• rude, abusive, or aggressive behavior;\u003Cbr/>\n• other\ncircumstances at the Platform’s discretion.\u003C/p>\n\u003Cp>\u003Cb>18.3.\u003C/b> The\nPlatform:\u003Cbr/>\n• is not obligated to provide prior notice;\u003Cbr/>\n•\nis not obligated to explain reasons;\u003Cbr/>\n• is not obligated to\nprovide evidence;\u003Cbr/>\n• is not obligated to restore access.\u003C/p>\n\u003Cp>\u003Cb>18.4.\u003C/b>\nRestriction or termination of access does not create obligations for\ncompensation, damages, or reimbursement by the Platform.\u003C/p>\n\u003Cp>\u003Cb>19. Data\nRetention in Cases of Restrictions / Blocking\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>19.1.\u003C/b> In\ncases of account suspension, restriction, or blocking, the Platform\nmay retain data associated with the account, including:\u003Cbr/>\n•\nprofile information;\u003Cbr/>\n• activity history;\u003Cbr/>\n•\ncorrespondence;\u003Cbr/>\n• other service-related data.\u003C/p>\n\u003Cp>\u003Cb>19.2.\u003C/b> Data\nmay be retained for a reasonable period for purposes including:\u003Cbr/>\n•\ninvestigation of potential violations;\u003Cbr/>\n• ensuring Platform\nsecurity;\u003Cbr/>\n• dispute resolution;\u003Cbr/>\n• compliance with\napplicable laws.\u003C/p>\n\u003Cp>\u003Cb>19.3.\u003C/b> The\nPlatform may conduct internal investigations at its discretion. The\ntiming and procedures of such investigations are not guaranteed.\u003C/p>\n\u003Cp>\u003Cb>19.4.\u003C/b> The\nPlatform may restore access where no violations are confirmed but is\nnot obligated to do so and is not required to disclose investigation\ndetails.\u003C/p>\n\u003Cp>\u003Cb>20. Account\nand Data Deletion\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>20.1.\u003C/b> In\nthe event of permanent account deletion, the Platform shall take\nreasonable measures to remove user data from active Platform systems\nwithin a reasonable timeframe, taking into account technical\ncharacteristics of the infrastructure.\u003C/p>\n\u003Cp>\u003Cb>20.2.\u003C/b> The\nPlatform may retain certain data where necessary for:\u003Cbr/>\n•\ncompliance with legal obligations;\u003Cbr/>\n• dispute resolution;\u003Cbr/>\n•\nensuring security;\u003Cbr/>\n• prevention of abuse;\u003Cbr/>\n• fulfillment\nof statutory requirements.\u003C/p>\n\u003Cp>\u003Cb>21. Limitation\nof Platform Liability (Maximum Extent Permitted)\u003C/b>\u003C/p>\n\u003Cp>\u003Cb>21.1.\u003C/b> To\nthe maximum extent permitted by applicable law, the Zama Platform\nshall not be liable for any losses, damages, or harm arising from the\nuse of or inability to use the Platform.\u003C/p>\n\u003Cp>\u003Cb>21.2.\u003C/b> In\nparticular, the Platform shall not be liable for:\u003Cbr/>\n• direct,\nindirect, incidental, special, punitive, or consequential damages;\u003Cbr/>\n•\nloss of profits;\u003Cbr/>\n• loss of revenue, clients, or business\nreputation;\u003Cbr/>\n• loss or distortion of data;\u003Cbr/>\n• actions or\nomissions of clients, professionals, salons, or other users;\u003Cbr/>\n•\nquality, legality, safety, or results of services;\u003Cbr/>\n• service\ninterruptions, errors, or failures;\u003Cbr/>\n• operation of AI systems,\nalgorithms, analytics, rankings, or recommendations.\u003C/p>\n\u003Cp>\u003Cb>21.3.\u003C/b> Even\nif the Platform has been advised of the possibility of damages, this\nshall not create additional liability.\u003C/p>\n\u003Cp>\u003Cb>21.4.\u003C/b>\nWhere liability is recognized by a competent authority or court, such\nliability shall be limited to the minimum extent permitted by law.\u003C/p>\n\u003Cp>\u003Cb>22.
